Collaborative or Litigation?

Divorce and the breakup of partnerships is a challenging and emotional experience for the parties and their families.  Historically, divorce has taken place in the courts in an adversarial context exacerbating the level of conflict and cost, emotional and financial. Collaborative practice is an alternative approach to lessen these burdens. The parties, each represented by their own collaboratively trained attorney, are assisted by a neutral mental health professional (MHP) and a neutral financial practitioner. The MHP protects the process by helping to manage conflict and the inevitable emotions which emerge during the separation and divorce process.  The MHP is an expert in development and family relationships and helps in the creation of the parenting plan in families with children. The neutral financial expert assists the couple in determining their division of property, in valuing businesses and assets, and in clarifying future financial obligations , avoiding the cost  and tension of competing experts.
